1 Definitions
- "Client", "you", "your" — the person or entity accessing the website or using the service.
- "We", "our", "us" — Velosofy BV, operating Jaarrekening.be.
- "Service" — the website, the API, and all related services we provide.
- "Account" — a registered user account on the platform.
- "API" — our application programming interface for programmatic access to the data.
- "Consumer" — a natural person acting outside their trade, business or profession. Section 11 and certain liability protections apply only to Consumers.
- "Business User" — any user acting in a professional or commercial capacity. Business Users are not entitled to the consumer-specific protections in these terms.
2 Company information
Jaarrekening.be is operated by
Velosofy BV acts as data controller for personal data processed through the service, in accordance with the GDPR and Belgian data protection law.
3 Accounts
When you create an account you must provide accurate, complete and current information. You are responsible for:
- keeping your credentials confidential;
- all activity that occurs under your account;
- telling us immediately about any unauthorised use;
- ensuring your use complies with applicable law.
One account per person or entity. Registering additional accounts to circumvent usage limits or obtain further free allowances is a material breach of these terms.
4 Trial period
New users may receive a free trial. Unless a specific offer states otherwise, the trial lasts seven (7) calendar days from activation and includes access to the paid features.
During the trial, company views remain subject to a limit of 10 companies to prevent abuse. Reaching that limit pauses further views until you move to a paid plan. We may suspend or revoke trial access, or change trial limits, to protect the service from misuse. A trial creates no entitlement to compensation, credits or continued access once the period or the limits are reached.
5 Fair usage and API access
Paid plans offer unlimited company lookups through the web interface, subject to a fair usage policy:
- Web interface: automated scraping, crawlers, bots, headless or automated browsers, scripts or any other tool used to systematically collect data from our web interface are strictly prohibited, regardless of request rate or volume. This applies no matter how slowly or how few requests are made. Such activity may result in throttling, suspension or termination without refund.
- API: for high-volume or automated use you must integrate via our official API using a valid API key. Each plan includes a monthly API request allowance that resets at the start of each calendar month. Additional requests can be purchased in packages; purchased requests do not expire and are only used once the monthly allowance for that month is exhausted.
Standard limits. Unless otherwise agreed in writing:
| Plan | Company views | API requests |
|---|---|---|
| Not signed in | 2 companies per day | No API access |
| Free account | 5 companies per 7 days | 10 per month |
| Starter | Unlimited | 500 per month |
| Pro | Unlimited | 2,500 per month |
| Higher volumes | Unlimited | Purchased request packages, or by separate written agreement |
Company view limits count distinct companies: opening a company you have already viewed within the period does not consume a further view.
Enforcement. We may monitor usage, enforce these limits, and suspend or block any account or IP address in violation of this policy.
6 Prohibited activities
The following are prohibited and will result in action against your account:
- Multiple account abuse: creating further accounts, by any means, to circumvent free tier limits, obtain additional free API requests or bypass usage restrictions. This includes accounts registered for the same person, organisation or affiliated entities.
- API abuse: using the API in a manner that circumvents rate limits, exploits free tier allocations across accounts, or otherwise obtains the service without appropriate payment.
- Automated account creation: using bots or scripts to create accounts or automate registration.
- Identity misrepresentation: providing false information at registration or misrepresenting your identity or affiliation to obtain benefits.
- Reselling access: reselling API access or sharing API keys with third parties.
Consequences. Breach of this section may result in:
- termination of all associated accounts without refund;
- a permanent ban covering the email addresses and payment methods used;
- blocking an entire email domain, where abuse involves multiple accounts from one organisation;
- IP address blocking for repeat offenders;
- legal action to recover damages where applicable.
7 Intellectual property
Unless stated otherwise, Velosofy BV and its licensors own the intellectual property rights in the material on Jaarrekening.be, including the interface, the design, our scores and ratios, and the structure of our database. All rights are reserved.
Underlying facts drawn from public registers are not owned by us. Your licence covers our presentation and processing of that material, and you must not:
- republish or redistribute substantial parts of our database as a competing product;
- sell, rent or sub-license material obtained from the service;
- use data mining, robots or similar tools against the web interface, as set out in Section 5.
Customers using the API may display and process the data they retrieve within their own product or internal systems, in accordance with their plan and Section 5.
8 Data sources and accuracy
Where the data comes from. Company information, annual accounts and related business data are derived from publicly available sources, including:
- Belgium: the National Bank of Belgium, the Crossroads Bank for Enterprises, and the Belgian Official Gazette;
- France: the Institut National de la Propriété Industrielle (INPI) and the Registre National des Entreprises;
- Luxembourg: filings published through the Luxembourg open data platform;
- Norway: the Brønnøysund Register Centre and the Register of Company Accounts;
- other official government registers and public databases.
No guarantee of accuracy. We make no representations or warranties as to the accuracy, completeness, reliability or timeliness of the data. In particular:
- data may contain errors or omissions originating in the source registers or introduced in processing;
- there may be a delay between official publication and appearance on our platform;
- ratios, scores and analyses are calculated automatically and may not reflect a company's complete financial picture;
- company status (active, bankrupt, dissolved) may not reflect the most recent legal position.
Not professional advice. The information is provided for information only and does not constitute financial, investment, legal or credit advice, a creditworthiness assessment, due diligence or audit services, or a substitute for advice from a qualified professional.
Your responsibility. You are responsible for verifying information before acting on it. We strongly recommend consulting official sources and qualified professionals before extending credit, entering into contracts, making investments or taking legal action.
9 Data protection
We process personal data in accordance with the GDPR and applicable Belgian and EU law. In summary:
- Legal basis: contract performance, legitimate interests, legal obligations, and your consent where applicable.
- Retention: account data is kept while your account is active and removed within 30 days of deletion, except where the law requires retention (invoicing records are kept for 7 years).
- Your rights: access, rectification, erasure, restriction, portability and objection, and withdrawal of consent where processing relies on it.
- Complaints: you may complain to your local supervisory authority. In Belgium this is the Gegevensbeschermingsautoriteit.
Full detail is in our privacy policy, and our use of cookies is described in the cookie policy.
10 Payment, pricing and VAT
Paid subscriptions are billed in advance, monthly or annually depending on the plan you choose. By subscribing you authorise us to charge your payment method on a recurring basis. API request packages are one-off purchases and are not recurring.
- Prices are shown in euro excluding VAT. VAT is added at checkout: 21% Belgian VAT where applicable, or the reverse charge for EU business customers supplying a valid VAT number.
- You may cancel a subscription at any time; access continues until the end of the paid period.
- Purchased API request packages are consumed as described in Section 5 and are not refundable once the requests have been used.
- Refunds are provided in accordance with applicable consumer protection law.
- We may modify pricing with 30 days' notice. Changes do not affect a period already paid for.
11 Right of withdrawal (consumers)
If you are a Consumer, under Book VI of the Belgian Economic Law Code and the EU Consumer Rights Directive you may withdraw from your purchase within 14 calendar days without giving a reason. The period expires 14 days after the contract is concluded.
To exercise it, tell us by a clear statement, for example an email to [email protected]. You may use the model form below, but you are not obliged to.
Model withdrawal form
To:
I hereby give notice that I withdraw from my contract for the provision of the following service: [description]
Ordered on: [date]
Name: [your name]
Address: [your address]
Date: [today's date]
Effects. We will reimburse all payments received from you without undue delay and no later than 14 days after being informed, using the same means of payment unless you expressly agree otherwise.
Exception. If you ask us to begin the service during the withdrawal period, you must pay an amount proportional to what has been provided up to the point of withdrawal. By starting to use the paid service immediately after purchase you expressly request that we begin before the period expires, and you lose the right of withdrawal once the service has been fully performed.
12 Linking and framing
You may link to our public pages provided the link is not deceptive, does not falsely imply sponsorship or endorsement, and fits the context of your site. Use of our logo or other artwork for linking requires a written licence.
You may not frame our pages in a way that alters their visual presentation without our written permission.
13 Limitation of liability
To the maximum extent permitted by law, we exclude representations, warranties and conditions relating to the website and its use. Nothing in these terms limits or excludes liability for death or personal injury, fraud or fraudulent misrepresentation, or any liability that cannot be excluded under applicable law.
We do not guarantee that the information is correct, complete or current, that the service will be uninterrupted, or that the material is kept up to date.
For paid plans, and to the extent permitted by law, our total liability for any claim arising out of or in connection with the service is limited to the amounts you paid us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect or consequential loss, including lost profits, lost business or loss of data.
Nothing in this section limits the statutory rights of Consumers.
14 Termination
For breach. If you breach these terms — including the fair usage policy in Section 5 or the prohibited activities in Section 6 — we may suspend or terminate your account and cancel your subscription without prior notice and without refund.
Without cause. We may discontinue your access for operational reasons on at least 30 days' notice, in which case you receive a pro-rata refund for any prepaid period remaining, and for any unused API request credits on your account.
On termination for any reason: your right to use the service ceases; we may delete your account and associated data subject to legal retention requirements; outstanding payment obligations remain due; and provisions that by their nature should survive termination will survive.
15 Changes to these terms
We may modify these terms. Material changes will be communicated by email or a prominent notice on the website at least 14 days before they take effect. Continued use after that date constitutes acceptance.
16 Governing law and disputes
These terms are governed by Belgian law. Disputes are subject to the exclusive jurisdiction of the Belgian courts, without prejudice to any mandatory protection available to Consumers in their country of residence.
EU consumers may also use the European Commission's Online Dispute Resolution platform.
17 Severability
If a provision of these terms is found unenforceable or invalid, that provision is severed and the remaining provisions continue in force.
